Applicants for domain names and hosting services should read this Disclaimer in relation to the specific Terms and Policies governing the relevent domain name space. When you submit your application form you are agreeing to those terms and policies and the following statement of Warranty and Indemnity and the Disclaimer.
Warranty and Indemnity
The customer agrees that it will protect, indemnify, save and hold Roundtable Productions Pty Ltd harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable legal fees assessed against Roundtable Productions Pty Ltd, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by it's customers, agents, employees or assigns.
The customer agrees to defend, indemnify and hold Roundtable Productions Pty Ltd harmless against liabilities arising from:
- any injury to any person or property caused by any products sold or distributed in association with services provided by Roundtable Productions Pty Ltd;
- any material furnished by the customer infringing or allegedly infringing on the proprietary rights of a third party;
- copyright violation and any defective products sold to a customer by or from services provided by Roundtable Productions Pty Ltd.
Disclaimer
Roundtable Productions Pty Ltd will not be responsible for any damages to the client's business resulting from use of a product or service provided by Roundtable Productions Pty Ltd and disclaims any warranty or merchantability or fitness for a particular purpose including data loss resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions of any kind caused by Roundtable Productions Pty Ltd or its employees or service providers for whom Roundtable Productions Pty Ltd is a reseller.
With regard to internet domain name registrations, renewals and transfers, the terms and conditions of the registry, the registrar of record or the internet service provider or hosting provider are also the terms and conditions of Roundtable Productions Pty Ltd. Failure to follow any terms and conditions may result in account cancellation and deactivation of any online services such email, hosting, and domain parking or redirection.
Roundtable Productions Pty Ltd does not provide advice of a legal nature and consequently advises clients to seek independent expert legal advice on matters such as intellectual property rights, patents and trademarks, and refers clients to the terms and conditions of internet domain name registration in the .au and global domain name spaces. Any service claims or guarantees made by parties for whom Roundtable Productions is a reseller are not service claims or guarantees of Roundtable Productions Pty Ltd. Furthermore Roundtable Productions Pty Ltd requires its customers to fully comply with all applicable laws concerning the privacy of on-line communications. Failure to comply with those laws will violate this policy.
On acceptance of services, the customer indemnifies Roundtable Productions Pty Ltd for the violation of any law or any of our terms and conditions, that results in loss to Roundtable Productions Pty Ltd or a third party or the bringing of any claim against Roundtable Productions Pty Ltd and agrees to pay any damages awarded against Roundtable Productions Pty Ltd, plus costs and reasonable legal fees.
Should any portion of this Terms of Use Agreement be found to be in violation of any law in any locality, then this agreement shall be deemed to be modified only to the extent necessary to be considered legal and enforceable in such locality. Roundtable Productions Pty Ltd reserves the right to amend or update terms and conditions without notice although reasonable attempts will be made to provide such notice, such as posting on this website.
